Kmart Lawsuit

In 2010, Kmart filed suit against Meadowbrook Creek, LLC and the City of Charlottesville seeking to halt the construction of the Whole Foods. Kmart claimed that the construction was in violation of part of its lease agreement, in which the developer agreed not to construct any other buildings or structures on property leased to Kmart.[2] The injunction was rejected by Judge Edward L. Hogshire in June, 2010.[3]
