September 14, 2021 email from Kevin McCollum to Sean Tubbs regarding initial subdivision denial

"The preliminary plat, which shows a by-right subdivision of TMP 76-24, also known as application SUB2021-116 is currently deferred. The Plat was originally denied because of outstanding issues that needed to be addressed prior to preliminary plat approval, primarily they were showing floodplain crossing and fill that requires special use permits. Our Subdivision Ordinance’s language allowed them to resubmit the denied plat to address issues and also to immediately request deferral on the resubmitted plat’s review. The Applicant is currently in the process of learning more about our special use permit process and may be moving towards submitting a special use permit for the floodplain crossings and fill. This special use permit or permits will need to be approved prior to the next review of the preliminary plat, that is why it is deferred. Ultimately, if they do not receive the appropriate permits they will not be able to move forward with the project in its proposed layout.
