Approval history
The Charlottesville Planning Commission approved a preliminary site plan application for the store and garage in the early hours of July 23, 2008[3].
Kmart lawsuit
In May 2010, Kmart Corp. filed a lawsuit against Meadowbrook Creek, alleging that land Kmart leases next to Whole Foods is being used for permanent improvements that Kmart's lease forbids, specifically beginning construction of the Hillsdale Drive Extended and other improvements within the boundaries of Kmart's leased property[4].
